Job Summary and Qualifications

Senior Operations Counsel will provide day-to-day legal support to assigned facilities and/or service lines, and will coordinate with other corporate departments that require input from, and integration with, the operations counsel section of the legal department. Senior operations counsel will support a hospital Division and/or one or more service lines or corporate departments, working closely with leadership and providing legal representation. Responsibilities include providing guidance on physician and referral source relationships and related legal issues, including, but not limited to, the Stark Law and the Antikickback Statute, contract review, and legal assistance with related operations. The Senior Operations Counsel will report to the Associate Managing Counsel Hospital Operations or Managing Counsel as applicable, and will assist Legal Operations VP and Managing/Associate Managing Counsel on projects as assigned.

Major Responsibilities:

· Provides direct legal support to assigned divisions/facilities/service lines, including but not limited to:

o Identifying legal risks and developing proactive compliance recommendations

o Assisting in legal evaluation and deployment of corporate strategic initiatives

o Developing communications related to significant legal issues

o Analyzing contract compliance, reviewing, and approving referral source contracts

· Practices and adheres to the “Code of Conduct” philosophy and “Mission and Value Statement”

· Performs other duties as assigned

Education & Experience:

· Juris Doctorate (JD) from accredited law school & active membership in at least one state bar, Required

· 10+ years of experience in /as legal counsel to healthcare systems/providers, which may include, but is not limited to

o Experience supporting hospitals

o Experience supporting behavioral health facilities and/or ambulance suppliers

· Admission to the Tennessee bar or admission to another state bar with ability to obtain Tennessee in-house counsel registration promptly, required
